Department of Veterans Affairs

In April of 2019, NAGE, representing employees at VA hospitals and clinics nationwide, filed a grievance against the VA on behalf of all bargaining unit employees. The Grievance alleged violations of the Fair Labor Standards Act (FLSA) and Title V (FEPA), among other violations.

The Law Offices of Snider and Associates, as the legal representatives for the Union, are working hard for the bargaining unit employees to ensure that their rights under federal law are upheld. As part of the process, we have been contacting VA employees about their job duties and how much unpaid overtime they have worked.

The Agency disputed that the Union’s Grievance was viable and in June of 2019 Arbitrator Joyce Klein was selected to resolve the dispute. Arbitrator Klein ruled in the Union’s favor that the Grievance could go forward, and arbitration hearings on the merits began in September of 2020.

The Parties have agreed to put on evidence concerning overtime damages on a location by location basis. Hearings for the Martinsburg VAMC began in 2022 and will continue throughout the year. The next location will be the Coatesville VAMC, with additional NAGE BU locations to follow.

All bargaining unit employees (other than pure Title 38 employees) whether or not they are members of the union, and regardless of position or pay grade, are covered by this grievance and could potentially benefit from a successful result. As such, if you are interested in making a claim for overtime benefits please click here if you work or worked at the Martinsburg VAMC and click here if you work or worked at the Coatesville VAMC. If you work or worked at another NAGE bargaining unit location complete the contact form to your right and an attorney will contact you directly.
