How to File an MSPB Appeal in DC

When filing an appeal with the MSPB, you can either file online or download the appeal form from the MSPB website and file the form by mail, by fax, or in person with your local MSPB office in DC. Once your appeal is filed, it’ll be assigned to an administrative judge (AJ), who will gather evidence and begin an investigation on your case.

Once an investigation has been done, an initial decision will be granted. If either party doesn’t agree with this initial decision, a petition for review can be filed. The board will review the case in further detail and then come to a final decision. If you don’t agree with the board’s final order, you’ll have sixty days to file an appeal with the United States Court of Appeals.

  • The level and type of employment
  • Whether alternative actions can be taken to prevent further offenses in the future
