FEMA Emergency Management Specialist – Program Delivery Manager (PDMG) Overtime Lawsuit

A lawsuit was recently filed in the United States Court of Federal Claims on behalf of past and present FEMA employees occupying the Emergency Management Specialist, Program Delivery Manager (“PDMG”) position. The lawsuit, captioned Coffer, et. al. v. United States, alleges that FEMA improperly designated the PDMG position as FLSA exempt when it should have been designated as FLSA non-exempt. This is a critical difference as to how overtime is paid.

Snider & Associates, LLC has previously litigated this case and it resulted in a successful outcome for all the Plaintiffs. The new case was filed because FEMA has continued to designate PDMGs as FLSA exempt and not pay proper overtime even though they have admitted that the PDMG position should be FLSA non-exempt and should be receiving time and one-half overtime.

On December 10, 2024, Judge David Tapp of the United States Court of Federal Claims approved Notice to be issued to individuals who meet the following definition:

Individuals, who at any time within three-years of joining this action, encumbered the IM-0089 or IC-0089 Emergency Management Specialist, Program Delivery Manager (“PDMG”) position within the Department of Homeland Security, Federal Emergency Management Agency (“FEMA”), and were designated as FLSA exempt while encumbering the IM-0089 or IC-0089 position, and were not paid FLSA overtime.
