How to File a Claim with the EEOC

When you’re a federal employee, your company will be assigned an Equal Opportunity Employment (EEO) counselor who you can reach out to in the event that you experience any sort of employment dispute at work. In order to file a complaint, you’ll need to explain the situation to the EEO counselor, who will then try to remedy the issue by suggesting EEO counseling with your employer.

If EEO counseling or an alternative dispute resolution program doesn’t provide a solution, the EEOC will begin an investigation into your case. Once a decision is made, you may receive liquidated damages for the infraction, or, if the EEOC determines no unlawful activity has occurred, you’ll have the opportunity to appeal the decision.

While you’re required to report employment law disputes to the EEOC before escalating them to a private lawsuit, you’ll have opportunities throughout the investigation to drop the complaint and move forward with a lawsuit instead.
