September of 2010, LIUNA Local 1029, representing VA employees in the Wilmington VA Medical Center, filed a grievance against the VA on behalf of all bargaining unit employees. The Grievance alleged violations of the Fair Labor Standards Act (FLSA) and Title V (FEPA), among other violations.
The Law Offices of Snider and Associates, as the legal representatives for the Union, are working hard for the bargaining unit employees to ensure that their rights under federal law are upheld. As part of the process, we have been busily contacting VA employees about their job duties and how much unpaid overtime they have worked.
In 2020, Arbitrator Daniel Brent issued a decision awarding damages to all employees who completed their testimony in the initial phase of the case. Since that time the Union and Agency have agreed to a claims process in order to expedite the resolution of additional claims on behalf of other bargaining unit employees.
At this time, only employees who provide information about their claim will be eligible for relief in this case. If you are or were in the LIUNA Local 1029 bargaining unit at the Wilmington VAMC, please contact us if you believe you have information to share about overtime for which you did not receive proper compensation.
All bargaining unit employees (who are not pure Title 38 employees), whether or not they are members of the union, and regardless of position or pay grade, are covered by this grievance and could potentially benefit from a successful result.
